Supreme Court of Western Australia overturns JDAP decision for the first time – Margie Tannock and Arohi Kaila
In the recent decision of Nairn v Metro Central Joint Development Assessment Panel, the Supreme Court of Western Australia ruled that a development approval relating to a multi-million dollar South Perth high-rise apartment complex should not have been granted. Chaney J found the decision by the Metro Central Joint Development Assessment Panel to approve the project invalid, as special planning regulations applicable in the South Perth area prohibit buildings that are predominantly residential in nature.
