Commentary on Amendments to the Construction Contracts (Security of Payments) Act 2004 (NT) – Gordon Smith

The Northern Territory Government, in September 2019, enacted a number of amendments to the Construction Contracts (Security of Payments) Act 2004 (NT), which came into effect on 3 February 2020. The amendments broadly cover the topics of the scope of claims, adjustments to the adjudication process, and changes to the enforcement regime. The amendments increase the differences between the respective security of payment legislation in the Northern Territory and Western Australia, jointly referred to as the “West Coast Model”. This article discusses the major amendments to the Northern Territory legislation, and highlights key differences between the two jurisdictions.
