{"id":10648,"date":"2018-03-02T17:25:23","date_gmt":"2018-03-02T06:25:23","guid":{"rendered":"http:\/\/sites.thomsonreuters.com.au\/journals\/?p=10648"},"modified":"2024-07-10T07:04:23","modified_gmt":"2024-07-10T07:04:23","slug":"fairness-for-financial-services-customers-csljs-special-issue","status":"publish","type":"post","link":"https:\/\/sites.thomsonreuters.com.au\/journals\/2018\/03\/02\/fairness-for-financial-services-customers-csljs-special-issue\/","title":{"rendered":"Fairness for financial services customers: C&amp;SLJ\u00e2\u20ac\u2122s Special Issue"},"content":{"rendered":"<p>With the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry now underway, the <em>Company and Securities Law Journal\u00e2\u20ac\u2122s<\/em> (C&amp;SLJ) just published <a href=\"https:\/\/www.westlaw.com.au\/maf\/api\/tocLocatorVM?searchds=AUNZ_SEARCHALL&amp;tocguid=AUNZ_AU_JOURNALS_TOC%7C%7CI3b0417e305df11e880e4e996c86e78d6&amp;productAO=AUNZ_TOC%7C%7CanzjourAUcompseclaw&amp;originates-from-link=false&amp;sortid=Citation&amp;ntocview=I3b0417e305df11e880e4e996c86e78d6&amp;qlink-label=No+7%2C+2017&amp;dsu=AUNZ_AU_JLCOMPANY&amp;stid=std-anz-tocbrowse&amp;ao=o.AUNZ_AU_JOURNALS_TOC%7C%7CI3b0417e305df11e880e4e996c86e78d6&amp;ndd=1\">Special Issue on Customer Protection in the Financial Services Industry<\/a>\u00c2\u00a0(<a href=\"https:\/\/sites.thomsonreuters.com.au\/journals\/2018\/01\/31\/company-and-securities-law-journal-update-vol-35-pt-7-special-issue-financial-services-protections\/\" target=\"_blank\" rel=\"noopener\">Volume 35 Part 7<\/a>) is timely.<\/p>\n<p>In his editorial, Bob Baxt spoke of being \u00e2\u20ac\u0153overwhelmed\u00e2\u20ac\u009d by the number of court cases over the last year and a half dealing with failures in the financial services industry \u00e2\u20ac\u201c particularly on the part of directors and regulators \u00e2\u20ac\u0153in failing to provide adequate protection for investors, consumers and others who have lost hundreds of millions of dollars\u00e2\u20ac\u009d.<\/p>\n<p>This Special Issue of C&amp;SLJ investigates the concepts of fairness and protection for financial services customers, the available regulatory mechanisms to achieve those ends, and suggests ideas for improvement in financial services regulation.<\/p>\n<p>The articles in the Special Issue by leading academics in the field, respond to a \u00e2\u20ac\u0153challenge\u00e2\u20ac\u009d, says M Scott Donald, Guest Editor, and Deputy Director of the Centre for Law, Markets and Regulation (CLMR) at the University of NSW.<\/p>\n<p>\u00e2\u20ac\u0153The challenge is that as the public clamour for remediation and change in the aftermath of each reported scandal grows, the prospect of a considered, precisely calibrated response dwindles,\u00e2\u20ac\u009d says Dr Donald.<\/p>\n<p>In its <a href=\"https:\/\/clmr.unsw.edu.au\/sites\/default\/files\/content_files\/PRESS%20RELEASE%20-%205%20February%202018.pdf\">press release<\/a> about the Special Issue, the CLMR said that the academic contributors to the issue offer \u00e2\u20ac\u0153perspectives &#8230; on the success of financial regulators in delivering qualities such as fairness and accountability to financial markets\u00e2\u20ac\u009d<\/p>\n<p>The themes of the Special Issue are explored through the following articles:<\/p>\n<ul>\n<li><strong>Regulating for Fairness in the Australian Funds Management Industry <\/strong><em>\u00e2\u20ac\u201c M Scott Donald<\/em><\/li>\n<li><strong>Whither Customer Protection in Financial Services?
