{"id":8846,"date":"2016-08-18T17:33:29","date_gmt":"2016-08-18T07:33:29","guid":{"rendered":"http:\/\/sites.thomsonreuters.com.au\/journals\/?p=8846"},"modified":"2024-07-10T07:54:40","modified_gmt":"2024-07-10T07:54:40","slug":"former-federal-court-judge-proposes-key-reforms-to-section-18c","status":"publish","type":"post","link":"https:\/\/sites.thomsonreuters.com.au\/journals\/2016\/08\/18\/former-federal-court-judge-proposes-key-reforms-to-section-18c\/","title":{"rendered":"Former Federal Court judge proposes key reforms to section 18C"},"content":{"rendered":"<p style=\"text-align: justify\">Amid the renewed debate on repealing or amending section 18C of the <em>Racial Discrimination Act 1975<\/em> (Cth), former Federal Court judge and acting NSW Supreme Court Justice Ronald Sackville AO has proposed key amendments to the legislation.<\/p>\n<p style=\"text-align: justify\">In an upcoming article in Thomson Reuters\u00e2\u20ac\u2122 <a href=\"https:\/\/sites.thomsonreuters.com.au\/journals\/category\/the-australian-law-journal\/\"><strong><em>Australian Law Journal<\/em><\/strong><\/a>, entitled \u00e2\u20ac\u0153Anti-Semitism, Hate Speech and Part 2A of the <em>Racial Discrimination Act\u00e2\u20ac\u009d<\/em>, Justice Sackville argues there are powerful policy reasons for retaining Part 2A and other hate speech laws, but that the legislation should be amended to remove references to offending and insulting and introduce a more demanding standard and substituting objective tests for subjective criteria.<\/p>\n<p style=\"text-align: justify\">The proposed amendments would achieve a more defensible balance, he says, between the legitimate protection of vulnerable groups from serious hate speech and the values of free speech.<\/p>\n<p style=\"text-align: justify\">Acting Justice Sackville writes:<\/p>\n<blockquote><p>The difficulties created by the drafting of the current legislation would be reduced by two significant amendments.\u00c2\u00a0One would substitute for the current \u00e2\u20ac\u02dcto offend, insult, humiliate or intimidate\u00e2\u20ac\u2122 with a more demanding standard such as \u00e2\u20ac\u02dcto degrade, intimidate or incite hatred or contempt\u00e2\u20ac\u2122.<\/p>\n<p>The other would be to replace the references to the subjective responses of groups targeted by hate speech with an objective test for determining whether the hate speech is likely to have the prohibited effect.<\/p>\n<p>An objective test would involve reference to the standards of a reasonable member of the community at large.\u00c2\u00a0In practice, as in so many areas of the law, this would involve courts exercising judgment in the light of their assessment of prevailing community standards, taking account of the evidence adduced in the individual case.<\/p><\/blockquote>\n<p style=\"text-align: justify\">NSW Supreme Court Justice Fran\u00c3\u00a7ois Kunc is the new General Editor of the <strong><em>Australian Law Journal<\/em>, <\/strong>in which Justice Sackville\u00e2\u20ac\u2122s article will soon be published (Vol 90 Part 9).<\/p>\n<p style=\"text-align: justify\">\u00e2\u20ac\u0153The <strong><em>Australian Law Journal<\/em><\/strong> has an essential national role to play where considered legal analysis can make a positive contribution to public debate,\u00e2\u20ac\u009d Justice Kunc says.<\/p>\n<p style=\"text-align: justify\">\u00e2\u20ac\u0153Acting Justice Sackville is one of the country\u00e2\u20ac\u2122s foremost legal minds and most experienced judges.
