{"id":9904,"date":"2017-04-30T18:46:47","date_gmt":"2017-04-30T08:46:47","guid":{"rendered":"http:\/\/sites.thomsonreuters.com.au\/journals\/?p=9904"},"modified":"2024-07-10T07:50:21","modified_gmt":"2024-07-10T07:50:21","slug":"alj-special-issue-on-indigenous-australians-and-interview-with-former-high-court-chief-justice-robert-french","status":"publish","type":"post","link":"https:\/\/sites.thomsonreuters.com.au\/journals\/2017\/04\/30\/alj-special-issue-on-indigenous-australians-and-interview-with-former-high-court-chief-justice-robert-french\/","title":{"rendered":"ALJ Special Issue on Indigenous Australians and Interview with former High Court Chief Justice Robert French"},"content":{"rendered":"<p style=\"text-align: justify\">May 2017 will mark the 90th anniversary of\u00c2\u00a0<a href=\"https:\/\/sites.thomsonreuters.com.au\/journals\/category\/the-australian-law-journal\/\" target=\"_blank\" rel=\"noopener\"><em>The Australian Law Journal<\/em><\/a> since it was first published in 1927.<\/p>\n<p style=\"text-align: justify\">As part of the 90th anniversary celebrations throughout 2017, the upcoming <a href=\"https:\/\/sites.thomsonreuters.com.au\/journals\/2017\/05\/08\/australian-law-journal-update-vol-91-pt-5-aljs-90th-anniversary-special-issue\/\" target=\"_blank\" rel=\"noopener\">May issue of ALJ<\/a> will be a <strong>Special Issue<\/strong> on the theme of Indigenous Australians and the Law, with guest editor <a href=\"http:\/\/www.law.unsw.edu.au\/profile\/megan-davis\" target=\"_blank\" rel=\"noopener\">Professor Megan Davis<\/a>, who was <a href=\"http:\/\/www.law.unsw.edu.au\/news\/2017\/03\/megan-davis-appointed-unsws-first-pro-vice-chancellor-indigenous\" target=\"_blank\" rel=\"noopener\">recently \u00c2\u00a0appointed<\/a> UNSW\u00e2\u20ac\u2122s first Pro Vice-Chancellor Indigenous.\u00c2\u00a0The May Special Issue is packed with other historic anniversary milestones and topics of key national urgency and significance, as well as the introduction of new Sections, including on statutory interpretation.<\/p>\n<p style=\"text-align: justify\">It is therefore quite fitting that one of these new Sections,\u00c2\u00a0\u00e2\u20ac\u0153The Legal Observer\u00e2\u20ac\u009d by Mr Michael Pelly,<span style=\"color: #ff6600\"><strong>*<\/strong><\/span>\u00c2\u00a0commences with an interview with recently retired High Court Chief Justice,\u00c2\u00a0<span style=\"text-decoration: underline\"><strong><em><a href=\"http:\/\/blog.thomsonreuters.com.au\/2017\/02\/french-high-court\/\" target=\"_blank\" rel=\"noopener\">The Hon Robert Shenton French AC<\/a><\/em><\/strong><em>,<\/em><\/span><strong><em>\u00c2\u00a0<\/em><\/strong>twelfth Chief Justice of Australia, who is himself a passionate advocate of the rights of Indigenous Australians\u00c2\u00a0and, indeed, for delivering <a href=\"http:\/\/www.smh.com.au\/federal-politics\/political-news\/former-high-court-chief-justice-robert-french-to-head-access-to-justice-inquiry-20170310-guv5fm.html\" target=\"_blank\" rel=\"noopener\">fairness and equality of treatment for all Australians<\/a>.<\/p>\n<p style=\"text-align: justify\">\u00e2\u20ac\u0153The Legal Observer\u00e2\u20ac\u009d is a new section dedicated to a roving discussion of topics outside the current scope of the existing ALJ sections. The transcript of the interview will be available in May,\u00c2\u00a0and readers can look forward to hearing the former Chief Justice&#8217;s thoughts on a range of matters, including:<\/p>\n<ul style=\"text-align: justify\">\n<li>his reflections on &#8220;leading&#8221; the High Court, the\u00c2\u00a0collegiality of &#8220;the French High Court&#8221;, the technical aspects of judgment-writing and the role of joint judgments in enhancing the\u00c2\u00a0efficiency of the Court and &#8220;the clarity with which it speaks&#8221;.<\/li>\n<li>his view on mandatory sentencing, <em>Kable<\/em>, <em>Kirk<\/em> and America, and the relationship between judicial speeches, judgment writing and the media.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-9933\" src=\"https:\/\/sites.thomsonreuters.com.au\/journals\/wp-content\/uploads\/sites\/3\/2017\/04\/Chief-Justice-Robert-French-Simon-Fieldhouse.jpg\" alt=\"Chief Justice Robert French Simon Fieldhouse\" width=\"274\" height=\"322\" \/>The interview also explores Mr French&#8217;s insights on the\u00c2\u00a0constitutional function of the High Court and the boundaries of power, and the judgment calls that final appellate judges are often required to make which fall somewhere in between developing the common law and\u00c2\u00a0engaging in &#8220;incremental law-making&#8221;.<\/p>\n<p style=\"text-align: justify\">Mr French also shared some advice on the &#8220;path to the High Court&#8221;, and hints on his future career path after the High Court: involving a role on the bench, albeit possibly in a milder clime.<\/p>\n<p style=\"text-align: justify\"><em><strong><span style=\"color: #ff6600\">*<\/span> Michael Pelly <\/strong>is a\u00c2\u00a0highly regarded journalist and legal writer, with over 30 years experience, including at The Sydney Morning Herald and The Australian.
